H.R. 806 - Artists' Contribution to American Heritage Act of 2003

H.R. 806, if passed, would amend the Internal Revenue Code of 1986 to enable artists to obtain a tax deduction equal to "fair market value" for charitable contributions of literary, musical, artistic, or scholarly compositions created by the donor.

The new legislation would allow donations of works, provided the contributed works were created at least 18 months prior to the date of donation.  Contributions must also be formally appraised and a written appraisal would need to be attached to the donor's tax return. The creator must deduct the entire amount the year the gift is made; the deduction can be taken only for income earned as an artist.

The new donation requirements also provide some new guidelines for institutions receiving such donations.  For example, the donors work must be related to the purpose of the institution that accepts the gift.

    I am writing to urge you to support H.R. 806, the Artists' Contribution to American Heritage Act. The passing of this bill would be greatly beneficial for artists and creators, a group containing some of our country's most valuable assets.

    In addition to providing artists with a much needed "fair market value" tax deduction, this bill will stimulate increasing contributions of literary, musical, artistic and scholarly compositions. This has positive implications for institutions receiving the donations and for society as a whole. As an affiliate of Student Advocate for the Arts (http://www.studentadvocatesforthearts.org) I am especially concerned with these impacts.

    I also urge you to contact Congressmen Roy Blunt (who introduced the Charitable Giving Act) and ask him to include H.R. 806 in the reconciliation of the House's Charitable Giving Act with the Senate's Care Act. Thank you for your concern, and I hope you will actively support H.R. 806.
